Welcome to Jesal Sweet House. These Terms of Service (“Terms”) govern your use of our website and the purchase of our products. By accessing our site or placing an order, you agree to be bound by these Terms.
The website is operated by Jesal Sweet House (heretofore referred to as “the Company”). Throughout the site, the terms “we”, “us” and “our” refer to the Company.
1. Online Shop Terms
- By agreeing to these Terms, you represent that you are at least 18 years of age, or that you have given us your consent to allow any of your minor dependents to use this site.
- You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction while using our service.
- A breach or violation of any of the Terms will result in an immediate termination of your services and order fulfillments.
2. Freshness & Product Information
- Perishable Nature: Because our sweets and savouries are 100% handmade fresh daily with zero preservatives, they are highly perishable. It is the customer’s responsibility to follow storage instructions (such as refrigeration or airtight containment) provided with the products.
- Visual Representation: We make every effort to display the colors, textures, and packaging of our products as accurately as possible on our store. Actual items received may have slight visual variations due to their handcrafted nature.
- We reserve the right to limit the sales of our products or services to any person, geographic region, or jurisdiction across Malaysia.
3. Accuracy of Billing & Account Information
- We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
- You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers, so that we can complete your transactions and contact you as needed.
4. Shipping, Delivery & Risk of Loss
- All local deliveries are handled by trusted third-party courier and logistics providers.
- While we guarantee that your order leaves our kitchen at peak freshness, we are not liable for delayed deliveries caused by unforeseen traffic, extreme weather, or incorrect shipping addresses provided by the user.
- Risk of damage or loss passes to you upon delivery of the items to the address provided during checkout.
5. Return, Refund & Cancellation Policy
- Due to food safety regulations and the fresh, perishable nature of handcrafted Indian sweets, we do not accept returns or exchanges once an item has been successfully delivered.
- If you receive an incorrect or damaged order, you must contact our support team within 2 hours of receipt with photographic proof. Legitimate complaints will be handled via replacements or store credit at the Company’s sole discretion.
- Orders cannot be cancelled or modified once they have entered the kitchen production phase.
6. Intellectual Property
- All content included on this site, such as text, custom graphics, brand logos, button icons, images, and digital downloads, is the exclusive property of Jesal Sweet House and is protected by Malaysian and international copyright laws.
7. Indemnification & Limitation of Liability
- Jesal Sweet House shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the misuse of our products, including improper storage or failure to check allergy disclosures (such as nuts, dairy, or gluten present in traditional recipes).
8. Governing Law
- These Terms of Service and any separate agreements whereby we provide you services or products shall be governed by, construed, and enforced strictly in accordance with the laws of Malaysia. Any legal actions or disputes shall fall under the exclusive jurisdiction of the Malaysian courts.
